McKinney-Vento Homeless Education Assistance Act

The McKinney-Vento Act ensures educational rights and protection for youth and children experiencing homelessness.

Who is considered homeless?

Anyone who lacks a fixed, regular and adequate night time residence is considered homeless. You qualify if you are:

  • sharing housing with others due to loss of housing, economic hardship or another similar reason
  • living in motels, camping grounds due to lack of adequate alternative accommodations
  • living in emergency or transitional shelters
  • abandoned in hospitals/ unaccompanied youth
  • living in a public/private place not designed for humans to live
  • living in cars, parks, abandoned buildings, bus or train stations
  • migratory children

Educational Rights for Children and Youth Lacking Fixed, Regular, and Adequate Housing

  • A parent does not need a permanent address to enroll in school.
  • A child cannot be denied school enrollment when school records or other enrollment documentation are not immediately available.
  • A student under McKinney Vento may be able to remain in the same school (school of origin) even if they move.
  • A parent has the right to request transportation to the school origin.
  • If a parent and the school disagree about school enrollment the parent may have the right to appeal.
A student has the right to participate in federal, state, or local programs for which they are eligible.

Services Provided by Newport News Public Schools

If a student is found eligible for services under the McKinney-Vento Act, the school district provides the following services:

  • Transportation for the student(s) whose address is out of school zone
  • Free meals
  • Clothing & School Supplies
  • Referrals to Community Resources
  • What Families Need to Know - Project Hope Virginia
